CIVIL LITIGATION: The Bonderud Law Firm Defends US Navy Captain in High-Profile Wrongful Death Case
The Bonderud Law Firm has been engaged to represent a retired US Navy Captain, in connection with a wrongful death lawsuit that was filed against him and others. The circumstances that give rise to the case have received widespread national media attention. Nearly all of the alleged relevant conduct occurred on the US Navy Base at Guantanamo Bay, Cuba in 2014 and 2015. The civil wrongful death lawsuit was filed in Jacksonville, Florida Circuit Court on January 7, 2021. See case no. 16-2021-CA-000103-XXXX-MA.
On May 5, 2021, we filed a Notice of Removal to the United States District Court for the Middle District of Florida, Jacksonville Division. In doing so, we argued that federal law applies exclusively to the US Naval Base at Guantanamo Bay, Cuba, and that the plaintiffs’ Civil Complaint, which alleges Florida-law claims, should be dismissed with prejudice. On September 22, 2021, the US District Court entered an order, staying all discovery in the case, pending final resolution of our motion to dismiss. The case is Tur, et al. v. Nettleton, et al., case no. 3:21-cv-483-MMH-JRK.
